Terms of service
Last updated:
Short version: you pay a deposit to start, the rest at launch, and once you've paid in full the website is yours. You can cancel a care plan whenever you like. If something here is unclear, email [email protected] and ask before you buy.
Who we are
Raijin Studios is run by Gary Barnes, a sole proprietor doing business as Raijin Studios ("we", "us"). These terms are an agreement between you (the business or person ordering) and us.
What these terms cover
- Website projects: a package bought on this website, or work described in a written quote we send you.
- Care plans: our monthly hosting, maintenance and support plans.
- This website: including the free website audit.
If your written quote says something different from these terms, the quote wins for that project.
Scope and changes
Your package or quote lists what's included: the pages, features and number of revision rounds. Anything outside that list is extra. Before we do extra work we'll tell you what it costs in writing, and we only start once you agree.
Payment
- Unless your quote sets a different schedule, you pay 50% of the project price as a deposit to start, and the remaining 50% when the site is ready to launch.
- Your site goes live on your domain once the balance is paid.
- Prices are in US dollars. Quotes are valid for 30 days.
- Payments are processed by our payment provider. We never see or store your full card details.
Timeline and your part
Timelines assume we get your content, feedback and approvals when we need them. If we're waiting on you for more than 30 days, we may pause the project and agree a new launch date with you. If we hear nothing for 90 days after reminding you, we may close the project and treat it as cancelled by you (see the refund and cancellation policy).
Revisions
Each round of revisions is one set of changes you send us together, at the design stage or after the build. Your package or quote says how many rounds are included. Further rounds are extra, quoted before we start them.
Who owns what
- Your domain, your logo and the content you give us are always yours.
- Once you've paid in full, you own the final design and code we made for your site, and you can take them to another developer or host at any time. Until then, we keep the rights to the work in progress.
- Fonts, open source libraries, photos and other parts made by others stay under their own licences, which we choose so you can use them on your site.
- We keep the right to reuse our general know how, techniques and our own tools that aren't specific to your business.
- We'll only show your site in our portfolio or marketing with your written permission.
Your content
You confirm that you have the right to use everything you send us (text, photos, logos) and that your business details, prices and claims are accurate. You're responsible for what your website says about your business.
Domains, hosting and other services
Your domain is registered in your name and paid to your registrar. Booking systems, payment providers, email and other services you connect to your site have their own terms and fees, which are between you and them. We're not responsible for their outages or changes.
Care plans
- Care plans are month to month. Billing starts when your site launches and renews each month.
- You can cancel any time by emailing us. The plan runs to the end of the month you've paid for and isn't refunded for part of a month.
- When a plan ends, we hand over your files and any account access we hold, so you can move the site wherever you like.
- What each plan includes is described on the care plans page.
After launch
If something we built doesn't work as agreed, tell us within 30 days of launch and we'll fix it at no charge. This doesn't cover changes made by anyone else, new features, or problems caused by other services.
What we can't promise
- We follow good practice for search, but nobody can guarantee search rankings or a number of visitors or leads.
- We build carefully and secure every site, but no one can promise a website will never be attacked or never go offline.
- Our total responsibility for any claim is limited to what you paid us for the project, or for a care plan, what you paid in the 12 months before the claim. We aren't responsible for indirect losses such as lost profits. Nothing here limits rights you have under the law that can't be limited.
Cancelling and refunds
How cancelling works, and what's refunded at each stage, is in our refund and cancellation policy, which is part of these terms.
Using this website
The free website audit runs Google's Lighthouse test through Google PageSpeed Insights. Only test websites you own or have permission to test, and don't use the audit or contact form to send spam or overload them. Audit results are provided as they are, for information. How we handle what you send us is in our privacy policy.
Disagreements
If something goes wrong, email us first and we'll try to put it right. These terms are governed by the laws of the Commonwealth of Virginia.
Changes to these terms
We may update these terms and will change the date at the top when we do. The terms in place when you placed your order apply to that order.
